The “CARL’S GOLFLAND 50th ANNIVERSARY” SWEEPSTAKES (“Sweepstakes”) starts at 12:01 a.m. Eastern Daylight Time (“EDT”) on 7/21/08 and ends at 11:59 p.m. EDT on 8/10/08 for online entry (“Online Entry Period”), ends in-store at participating retail locations on 8/10/08 and ends on 8/10/08 for the postmarking of all mail-in entries as detailed below. The sponsor of this Sweepstakes is Carl’s Golfland, 1976 S. Telegraph Road, Bloomfield Hills, MI 48302 (the “Sponsor”). The Sweepstakes shall be subject to these Official Rules, and by entering, all participants agree to be bound by the terms and conditions herein. Certain restrictions may apply.
ELIGIBILITY: THIS SWEEPSTAKES IS OPEN ONLY TO LEGAL RESIDENTS OF THE CONTIGUOUS CONTINENTAL UNITED STATES AND RESIDENTS OF THE CANADIAN PROVINCE OF ONTARIO, TWENTY-ONE 21 YEARS OF AGE OR OLDER AS
OF ENTRY DATE. Employees and their immediate family members (specifically defined as a parent, sibling, child or grandparent) of Sponsor, West Coast Marketing, a division of the Susquehanna Hat Company (“West Coast Marketing”) (collectively, the “Promotion Parties”), their respective affiliates, subsidiaries, parent companies, divisions, advertising, promotion and public relations agencies, prize suppliers and their respective officers, directors, employees, agents, independent contractors, representatives and agencies, and those living in the household of same (whether related or not) are not eligible to enter or win. Where a travel prize includes a travel companion, the travel prize winner’s travel companion is required to be twenty-one (21) years of age or older as of winner notification. This Sweepstakes is void in Alaska, Hawaii, Puerto Rico, all U.S. territories and possessions, Canadian Provinces and Territories of Alberta, Manitoba, Newfoundland and Labrador, Nova Scotia, Quebec, Yukon, British Columbia, New Brunswick, Northwest Territories, Nunavut, Prince Edward Island and Saskatchewan and all overseas military installations and where prohibited or restricted by law.
HOW TO ENTER AT PARTICIPATING CARL’S GOLFLAND RETAIL LOCATIONS OR BY MAIL: Beginning on 7/21/08 and ending at the end of business on 8/10/08 and while supplies last, official entry forms will be available at participating Carl’s Golfland retail locations. On this Official Entry Form or on a plain piece of paper 3” x 5” or on a postcard, handprint your name, street address, city, state, zip code, daytime telephone number, age, and (optionally) your e-mail address. Deposit your completed entry in the in-store “CARL’S GOLFLAND 50th ANNIVERSARY” SWEEPSTAKES display at the participating Carl’s Golfland retail location (“In-Store Entry”)

The Promotion Parties, Prize Suppliers (as detailed below), and any and all Internet server(s) and access provider(s), and each of their respective affiliates, subsidiaries, parent corporations, retailers and advertising and promotional agencies, and all of their officers, directors, shareholders, employees and agents (collectively, “Releasees”) are not responsible for: any incorrect or inaccurate entry information; human errors; technical malfunctions; failures, omissions, interruptions, deletions or defects of any telephone network, computer online systems, computer equipment, servers, providers, or software, including without limitation any injury or damage to participant’s or any other person’s computer relating to or resulting from participation in the Sweepstakes; inability to access the Entry Site or any other web page; theft, tampering, destruction, or unauthorized access to, or alteration of, entries; data that is processed late or incorrectly or is incomplete or lost due to telephone, computer or electronic malfunction or traffic congestion on telephone lines or the Internet or any web site (including the Entry Site) or for any other reason whatsoever; entries that are late, lost, stolen, misdirected, mutilated, or postage due; typographical, printing or other errors; or any combination thereof. False, fraudulent or deceptive entries or acts shall render entrants ineligible. By entering the Sweepstakes, entrants affirm that they have read and accepted these Official Rules. The Sweepstakes shall be governed by and construed in accordance with the laws of the State of Michigan, United States. By entering the Sweepstakes, entrants hereby submit to the jurisdiction and venue of the federal and state courts of the State of Michigan, United States and waive the right to have disputes arising out of the subject matter hereof adjudicated in any other forum. The information obtained via the entry will be used by Sponsor and its affiliates for marketing purposes. Sponsor and its affiliates would like to use this information to contact you either by mail or email with updates about special promotions or offers. If you prefer not to receive updates, do not check the appropriate box online. Any entry information collected from the Sweepstakes shall be used only in a manner consistent with the consent given by entrants at the time of the entry, with these Official Rules and with the Sponsor’s Online Privacy Policy, which can be accessed at the Entry Site.
WINNER SELECTION: Winners will be selected in a random drawing from among all eligible entries on or about 8/22/08 by West Coast Marketing, an independent judging organization, whose decisions are and shall be final and binding in all matters relating to this Sweepstakes. Prize winners will be notified by e-mail, certified mail and/or telephone by 8/31/08 and may be required to execute and return a notarized Affidavit of Eligibility/Release of Liability, an IRS W-9 form and where legal, a Publicity Release form within ten (10) days of date of issuance. Canadian winners will be required to correctly answer, without assistance of any kind, a mathematical skill-testing question administered by telephone, e-mail or mail. Where applicable, a prize winner’s travel companion will also be required to complete and return a notarized Release of Liability form within this same 10-day time period. Failure to return all required forms within this time period, or to comply with any other provision herein, may result in the applicable winner being disqualified and an alternate winner may (at Sponsor’s sole discretion), be selected. If a prize notification or prize is returned as undeliverable for any reason, the prize may (at Sponsor’s sole discretion) be awarded to an alternate winner in a subsequent random drawing. Prizes are not transferable, assignable, or redeemable for cash. No substitution for a prize by a winner will be allowed. If necessary, due to unavailability of a prize for any reason, a prize of equal or greater value will be awarded at the sole discretion of the Sponsor. Unclaimed prizes will remain the property of the Sponsor and/or Prize Supplier and will not be awarded.
All Federal, state, provincial and local tax liabilities are the responsibility of the winners. Acceptance of a prize constitutes permission (except where prohibited) for the Sponsor and/or Prize Suppler to use the winner’s name, likeness, biography, statements, and any other similar materials for marketing, promotional and publicity purposes without additional compensation or any limitation of any kind.

Tee It Up With Tiger Prize. Prize consists of a trip for one (1) to play one (1) hole of golf with Tiger Woods (specific location determined by Sponsor in its sole discretion). Prize includes roundtrip coach-class airfare for one (1) from a major commercial airport near winner’s home (determined by Sponsor and Prize Suppler in their sole discretion) to the destination city (specific location determined by Sponsor in its sole discretion); two (2) consecutive nights accommodations at a hotel determined by Sponsor in its sole discretion (single standard room, room and tax only); admission to the Tiger Woods Golf Clinic; one (1) Golf outing including eighteen (18) holes of golf; and the opportunity to play one (1) hole of golf with Tiger Woods (details determined by Sponsor and Prize Supplier in their sole discretion). Prize consists of a trip for one (1) and the opportunity to participate in the Soren-slam package at the Annika Academy in Orlando, Florida for three (3) days and three (3) nights (“Package”). Specific dates of the Package are 11/13/2008 – 11/15/2008. Prize includes the opportunity to play nine (9) holes of golf with Annika Sorenstam (“Annika”), attend a clinic with Annika, have lunch with Annika and participate in golf instruction at the Academy. Prize consists of a trip for one (1) to the Nike World HQ in Beaverton, OR (specific location determined by Sponsor in its sole discretion) including roundtrip coach-class airfare for one (1) from a major commercial airport near winner’s home (determined by Sponsor and Prize Supplier in their sole discretion) to an Oregon airport selected by Sponsor and Prize Supplier and one (1) night accommodations at a hotel determined by Sponsor in its sole discretion (single standard room, room and tax only). Prize consists of a trip for one (1) including roundtrip coach-class airfare for one (1) from a major commercial airport near winner’s home (determined by Sponsor and Prize Supplier in their sole discretion) to Detroit, MI, one (1) night accommodations at a hotel determined by Sponsor in its sole discretion (single standard room, room and tax only) and the opportunity to play 18 holes of golf and have lunch at a golf course to be selected by the Sponsor. If the Winner lives less than 400 miles from the Detroit Metro Area they will be required to provide their own transportation. Unless specified above as included, all meals, gratuities, excursions, insurance, incidentals, departure and airport taxes and fees and any other expenses not specified herein are the sole responsibility of the winner. All travel is subject to airline, hotel, event, and athlete and/or personality availability and other restrictions may apply. Only one (1) prize per person will be awarded. No substitution by a winner of winner’s prize shall be allowed. If necessary due to unavailability, a prize of equal or greater value will be substituted at the sole discretion of Sponsor. Prizes are not transferable or redeemable for cash. Except where prohibited, all Federal, state, local or other tax liabilities, if any are the sole responsibility of the winners. Acceptance of a prize constitutes permission (except where prohibited by law) to use the winner’s name, address (city and state or city only), voice, photograph, likeness, biographical information and statements for advertising, promotional or publicity purposes without additional compensation or limitation. Odds of winning any prize are determined by the total number of eligible entries received and are equal regardless of method of entry.

LIMITATIONS ON LIABILITY/RELEASE:
By entering this Sweepstakes, entrants agree that the Releasees shall not be liable for personal injuries, death, damages, expenses or costs or losses of any kind resulting from participation or inability to participate in this Sweepstakes or acceptance of or use or inability to use a prize or parts thereof including, without limitation, claims, suits, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light (whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory. HOW WILL DISPUTES BE HANDLED?: Each entrant agrees that (1) any and all disputes, claims, and causes of action arising out of or in connection with this promotion, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court within the State of Michigan; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this promotion, but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
