NO PURCHASE IS NECESSARY TO ENTER OR WIN A PRIZE IN THIS SWEEPSTAKES.

A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.

The “CARL’S GOLFLAND 65th ANNIVERSARY” SWEEPSTAKES (“Sweepstakes”) starts at 12:01 a.m. Eastern Daylight Time (“EDT”) on 7/28/23 and ends at 11:59 p.m. EDT on 8/13/23 for online entry (“Online Entry Period”) and ends in-store at the Sponsor’s (defined below) participating retail locations at local store closing on 8/13/23 with both methods of entry as detailed below. The sponsor of this Sweepstakes is Carl’s Golfland Inc., 1976 S. Telegraph Road, Bloomfield Hills, MI 48302 (the “Sponsor”). The Sweepstakes shall be subject to these Official Rules, and by entering, all participants agree to be bound by the terms and conditions herein. Certain restrictions may apply.

ELIGIBILITY: THIS SWEEPSTAKES IS OPEN ONLY TO LEGAL RESIDENTS OF THE FIFTY (50) UNITED STATES, THE DISTRICT OF COLUMBIA AND CANADA (EXCEPT THE PROVINCE OF QUEBEC), TWENTY-ONE 21 YEARS OF AGE OR OLDER AS OF ENTRY DATE. Employees and their immediate family members (specifically defined as a parent, sibling, child or grandparent) of Sponsor, Prize Suppliers (as defined below), their respective affiliates, subsidiaries, parent companies, divisions, advertising, promotion and public relations agencies, and their respective officers, directors, employees, agents, independent contractors, representatives and agencies, (collectively, the “Sweepstakes Entities”) and those living in the household of same (whether related or not) are not eligible to enter or win. Where a travel prize includes a travel companion, the travel prize winner’s travel companion is required to be twenty-one (21) years of age or older as of winner notification. This Sweepstakes is void in Puerto Rico, all U.S. territories and possessions, the Province of Quebec and all overseas military installations and where prohibited or restricted by law.

HOW TO ENTER VIA THE INTERNET: During the Online Entry Period, you may enter online by logging on to the website at www.carlsgolfland.com (“Entry Site”) and following the directions for Sweepstakes entry; providing your name, street address, city, state/province, zip/postal code, country, daytime telephone number, date of birth, your email address and clicking the Submit button. By completing the foregoing to a successful conclusion, you will receive one (1) entry in the Sweepstakes (“Online Entry”). ALL ONLINE ENTRIES MUST BE RECEIVED BY 11:59 P.M. EDT ON 8/13/23.

HOW TO ENTER AT PARTICIPATING CARL’S GOLFLAND RETAIL LOCATIONS: Beginning at 12:01 am EDT on 7/28/23 and continuing until the close of business on 8/13/23 you may enter by accessing the Entry Site using specially marked kiosks (each a “Kiosk”) at participating Carl’s Golfland retail locations and following the directions for Sweepstakes entry; providing your name, street address, city, state/province, zip/postal code, country, daytime telephone number, date of birth and your email address and clicking the Submit button. By completing the foregoing to a successful conclusion, you will receive one (1) entry in the Sweepstakes (“Kiosk Entry”). ALL KIOSK ENTRIES MUST BE RECEIVED BY CLOSE OF BUSINESS ON 8/13/23 AT PARTICIPATING RETAIL LOCATIONS.

Online Entry and Kiosk Entry may be referred to hereafter individually as an “Entry” and in the plural as “Entries”. Each such individual submitting such Entry may be referred to hereafter as an “Entrant”.

ONLY ONE (1) ENTRY PER PERSON AND/OR EMAIL ADDRESS WILL BE ACCEPTED FOR THIS SWEEPSTAKES REGARDLESS OF METHOD(S) OF ENTRY.

The Sweepstakes Entities, Prize Suppliers (as detailed below), and any and all Internet server(s) and access provider(s), and each of their respective affiliates, subsidiaries, parent corporations, retailers and advertising and promotional agencies, and all of their officers, directors, shareholders, employees and agents (collectively, “Releasees”) are not responsible for: any incorrect or inaccurate Entry information; human errors; technical malfunctions; failures, omissions, interruptions, deletions or defects of any telephone network, computer online systems, computer equipment, servers, providers, or software, including without limitation any injury or damage to participant’s or any other person’s computer relating to or resulting from participation in the Sweepstakes; inability to access the Entry Site or any other web page; theft, tampering, destruction, or unauthorized access to, or alteration of, Entries; data that is processed late or incorrectly or is incomplete or lost due to telephone, computer or electronic malfunction or traffic congestion on telephone lines or the Internet or any web site (including the Entry Site) or for any other reason whatsoever; Entries or mail that is late, lost, stolen, misdirected, mutilated, or postage due; typographical, printing or other errors; or any combination thereof. For purposes of this Sweepstakes, an Entry is "received" online when the Sponsor's server records the Entry information. Proof of sending (such as an automated computer receipt confirming Entry or "thanks for entering" message) does not constitute proof of actual receipt of an Entry for purposes of this Sweepstakes. Proof of entering information at the Entry Site online or at a Kiosk is not considered proof of delivery or receipt. Illegible, incomplete, mechanically reproduced and duplicate Entries will be disqualified. All Entries become the property of the Sponsor and will not be acknowledged or returned. False, fraudulent or deceptive Entries or acts shall render Entrants ineligible. By entering the Sweepstakes, Entrants affirm that they have read and accepted these Official Rules. The Sweepstakes shall be governed by and construed in accordance with the laws of the State of Michigan, United States. By entering the Sweepstakes, Entrants hereby submit to the jurisdiction and venue of the federal and state courts of the State of Michigan, United States and waive the right to have disputes arising out of the subject matter hereof adjudicated in any other forum. The information obtained via the Entry will be used by Sponsor and its affiliates for marketing purposes. Sponsor and its affiliates would like to use this information to contact you either by mail or email with updates about special promotions or offers. If you prefer not to receive updates, do not check the appropriate box online. Any Entry information collected from the Sweepstakes shall be used only in a manner consistent with the consent given by Entrants at the time of the Entry, with these Official Rules and with the Sponsor’s Online Privacy Policy, which can be accessed at the Entry Site.

WINNER SELECTION: Winners will be selected in a random drawing from among all eligible Entries on or about 8/24/23 by Stuart M. Faye PLLC, whose decisions are and shall be final and binding in all matters relating to this Sweepstakes. Potential prize winners will be notified by email, certified mail and/or telephone by 9/17/23 and may be required to execute and return either a notarized Affidavit of Eligibility/Release of Liability, an IRS W-9 form and where legal, a Publicity Release form (U.S. prize winners) or a Declaration of Eligibility/Release of Liability/Publicity Release (Canadian prize winners) within ten (10) days of date of issuance. Canadian winners will be required to correctly answer, without assistance of any kind, a timed mathematical skill-testing question administered by telephone or email. Where applicable, a prize winner’s travel companion will also be required to complete and return an executed Release of Liability form within this same 10-day time period. Failure to return all required forms within this stated time period, or to comply with any other provision herein, may result in the applicable winner being disqualified and an alternate winner may (at Sponsor’s sole discretion), be selected. If a prize notification or prize is returned as undeliverable for any reason, the prize may (at Sponsor’s sole discretion) be awarded to an alternate winner in a subsequent random drawing. Prizes are not transferable, assignable, or redeemable for cash. No substitution for a prize by a winner will be allowed. If necessary, due to unavailability of a prize for any reason, a prize of equal or greater value will be awarded at the sole discretion of the Sponsor. Unclaimed prizes will remain the property of the Sponsor and/or Prize Supplier and will not be awarded.

All Federal, state, provincial and local tax liabilities are the responsibility of the winners. Acceptance of a prize constitutes permission (except where prohibited) for the Sponsor and/or Prize Supplier to use the winner’s name, likeness, biography, statements, and any other similar materials for marketing, promotional and publicity purposes without additional compensation or any limitation of any kind.

PRIZES: The following are the prizes available to be awarded in the Sweepstakes and all approximate retail values are stated in U.S. dollars:

1. Trip to Pinehurst Resort for 2 Prize. Prize consists of a trip for two (2) including roundtrip coach-class airfare for two (2) from a major commercial airport near winner’s home (determined by Sponsor in their sole discretion). Includes two nights of accommodation at The Carolina Hotel for 2 people (sharing 1 room) with breakfast and dinner daily, plus three rounds of golf with cart, practice facilities, range balls and club storage. Including play on Pinehurst No. 2 and $200.00 travel stipend for incidentals. Prize Supplier: Carl’s Golfland. ARV $6050.00

2. Trip to Whistling Straights for 2 Prize. Prize consists of a trip for two (2) including roundtrip coach-class airfare for two (2) from a major commercial airport near winner’s home (determined by Sponsor in their sole discretion). Two nights at The American Club or Inn on Woodlake Three, 18-hole rounds of golf per person. One round per person on The Straits at Whistling Straits, one round on The River at Blackwolf Run, and one round on your choice of The Irish at Whistling Straits or The Meadow Valleys at Blackwolf Run. Golf car fees at Blackwolf Run. Forecaddie fees on River and Meadow Valleys courses (does not include caddie gratuity). Caddie fees on The Straits and Irish courses (does not include caddie gratuity). $200.00 travel stipend for incidentals. Prize Supplier: Carl’s Golfland. ARV $6050.00

3. Carl’s Golfland Ultimate Fitting and Golf Experience Prize. Prize consists of a trip for two (2) including roundtrip coach-class airfare for two (2) from a major commercial airport near winner’s home (determined by Sponsor and Prize Supplier in their sole discretion) to Detroit, MI and two (2) consecutive nights’ accommodations at a hotel determined by Sponsor in its sole discretion (double standard room, room and tax only). The winner will receive a full bag fitting in the Launch Pad Fitting Center in Bloomfield Hills, MI. The winner will receive a full set of clubs determined by the fitting results. $200.00 travel stipend for incidentals Prize Supplier: Carl’s Golfland. ARV $3200.00

Travel prizes are subject to the following conditions: All travel arrangements are to be administered by Sponsor or its designee(s). Unless specified above as included, all meals, gratuities, excursions, insurance, incidentals, departure and airport taxes and fees and any other expenses not specified herein are the sole responsibility of the winner. All travel is subject to airline, hotel, event, and athlete and/or personality availability and other restrictions may apply. Where specific dates of travel are specified or required to attend a specific event, winner must be able to travel on such dates or prize will be forfeited in its entirety and may (at Sponsor’s sole discretion) be awarded to an alternate. Winner and (where applicable) his or her travel companion must travel together on the same itinerary. Winner and (where applicable) his or her travel companion will be required to provide valid government issued photographic ID at time of travel including but not limited to valid passport when required. No changes will be made to travel details once any portion of travel arrangements has been made. Unless specified otherwise in a prize description above, if winner lives within 400 miles of a prize destination, airfare portion of prize will be forfeited and no additional prize element substituted. Prize conditions may be added or modified by Sponsor. Releasees are not responsible for cancellation of any element of a prize or for changes in schedule of any element of a prize. All taxes/fees and expenses in conjunction with airline tickets are the responsibility of the winner, including all necessary government documentation. Hotel accommodations consist of room and room tax charges only. Travel must originate from and end at the same airport. Once travel commences, no stopovers are permitted; if stopover occurs, full fare will be charged from stopover point for the remaining segments, including return, of the trip.

The total ARV of all prizes to be awarded in this Sweepstakes is $15,300.00 USD.

Only one (1) prize per person will be awarded. No substitution by a winner of winner’s prize shall be allowed. If necessary due to unavailability, a prize of equal or greater value will be substituted at the sole discretion of Sponsor. Prizes are not transferable or redeemable for cash. Except where prohibited, all Federal, state, provincial, local or other tax liabilities, if any are the sole responsibility of the winners. Acceptance of a prize constitutes permission (except where prohibited by law) to use the winner’s name, address (city and state/province or city only), voice, photograph, likeness, biographical information and statements for advertising, promotional or publicity purposes without additional compensation or limitation. Odds of winning any prize are determined by the total number of eligible Entries received and are equal regardless of method of Entry.

Warranty Disclaimer: All prizes are awarded “AS IS”. Any and all warranties for the prizes are contained in the manufacturer’s warranty. Except as otherwise provided in these Official Rules, Releasees make no warranties, representations or guarantees, expressed or implied, in fact or in law, respecting the performance or use of the prizes, including, without limitation, quality, merchantability, and fitness for a particular purpose, and the winner shall look solely to the manufacturer for such warranties, if any. Furthermore, no responsibilities are accepted for any additional expenses, omissions, delays, re-routing, or acts of any government or authority.

LIMITATIONS ON LIABILITY/RELEASE:

By entering this Sweepstakes, Entrants agree that the Releasees shall not be liable for personal injuries, death, damages, expenses or costs or losses of any kind resulting from participation or inability to participate in this Sweepstakes or acceptance of or use or inability to use a prize or parts thereof including, without limitation, claims, suits, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light (whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory. Winners release the Releasees from any and all liability and responsibility with respect to the prize (including any property loss, damage, personal injury or death). Winners acknowledge that the aforementioned individuals and entities have neither made nor are in any manner responsible for any warranty, representation or guarantee, expressed or implied, in fact or in law, related to the prizes.

Releasees shall not be liable to winner or any other person for failure to supply the prize or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulation(s), order(s) or request(s) prove(s) to be invalid), equipment failure, terrorist acts, war, fire, unusually severe weather, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, or any other cause beyond Releasees’ sole control. Releasees shall not be responsible for any cancellations, delays, diversions or substitutions or any act or omissions whatsoever by the air carrier(s), hotel(s), or other transportation companies or any other persons providing any of these services and accommodations to passengers including any results thereof such as changes in services or accommodations necessitated by same. Releasees shall not be liable for any loss or damage to baggage. In the event the Sweepstakes is corrupted for any reason, Sponsor reserves the right to cancel the Sweepstakes and substitute another in its place.

HOW WILL DISPUTES BE HANDLED?: Each Entrant agrees that (1) any and all disputes, claims, and causes of action arising out of or in connection with this Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court within the State of Michigan; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys' fees; and (3) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Entrant and Sponsor in connection with this Sweepstakes, shall be governed by, and construed in accordance with the laws of the State of Michigan, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Michigan or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of Michigan.

Telegraph Rd. Bloomfield Hills, MI 48302. Residents of Canada and Vermont only may omit the return postage on their requests. Official Rules are also available at the participating Carl’s Golfland retail locations and at the Entry Site during the Online Entry Period.

Other names and brands may be claimed as the property of others.
