CARL’S GOLFLAND GIVEAWAY RULES & DETAILS

OFFICIAL RULES:
Carl’s Golfland Giveaways are open to legal residents of the fifty (50) United States (and the District of Columbia), who are 18 years old and older at the time of entry, unless specified differently in the contest medium. Void where prohibited. Employees of Carl’s Golfland Inc. and their respective related companies, parents, subsidiaries, affiliates, and agents and any agencies or other companies involved in the development or execution of the Giveaway or production or distribution of Giveaway materials, as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible. The Giveaway is subject to all applicable federal, state, local laws and regulations.
NO PURCHASE OR PAYMENT NECESSARY TO ENTER INTO BRAND’s GIVEAWAYs. A PURCHASE DOES NOT IMPROVE YOUR CHANCES OF WINNING THIS GIVEAWAY.
GIVEAWAY’s are to be communicated using various medium. Facebook post, Twitter Post, Instagram Post, Text, Email, Web Form, Etc.. All are to be referred to as the “Giveaway Post”

Agreement to Official Rules: By participating in the Giveaway, each entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsor, which are final and binding in all matters related to the Giveaway.

HOW TO ENTER:
During the Giveaway Period, entrants must follow all instructions as stated in the Giveaway Post. All entries must be received before the end time listed on the last day of each giveaway period. Any attempt by any participant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that participant’s entries and that participant will be disqualified. Use of any automated system to submit entries is prohibited and will result in disqualification. In the event of a dispute as to any online entry, the authorized account holder of the email address or social media account used to enter will be deemed to be the entrant. Potential winners may be required to show proof of being the authorized account holder.
ALL POTENTIAL WINNING ENTRIES ARE SUBJECT TO VERIFICATION BY SPONSOR, WHOSE DECISIONS ARE FINAL. AN ENTRANT IS NOT A WINNER OF ANY PRIZE UNLESS AND UNTIL ENTRANT’S ELIGIBILITY HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. SPONSOR WILL NOT ACCEPT SCREEN SHOTS OR OTHER EVIDENCE OF WINNING IN LIEU OF ITS VALIDATION PROCESS.

DRAWINGS:
On or about the day following each Giveaway Period, The Winner(s) will be selected for the Giveaway Period in a random drawing from all giveaway entries in our database. Limit one prize per winner in connection with this Giveaway during the Promotion Period. If any potential winner cannot be contacted, within the required time period, he/she forfeits prize. If any potential winner cannot be contacted or if a prize is returned as undeliverable, he/she forfeits prize. In the event that a potential winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate potential winner by random drawing from among all remaining eligible entries. Prizes will be fulfilled approximately 4-5 days after the conclusion of the Giveaway.

GIVEAWAY PERIODS:
Giveaway period is time as noted in the Giveaway Post.

PRIZE:
Each winner will receive prize associated with the giveaway period as outlined in the Giveaway Post. Odds of winning a Giveaway prize depend on the number of eligible entries received during the Giveaway Period. Prize is non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute the prize for one of equal or greater value if the designated prize should become unavailable for any reason. Winner is responsible for all taxes and fees associated with prize receipt and/or use.

PUBLICITY:
Except where prohibited, participation in the Giveaway constitutes winner’s consent to Sponsor’s use of winner’s name, likeness, voice, opinions, biographical information, hometown and state for promotional purposes in any media, without further payment or consideration.

GENERAL CONDITIONS:
Sponsor reserves the right to cancel or modify the Giveaway if fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity of the Giveaway, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the prizes at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Giveaway or to be acting in violation of these Official Rules, or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately damage any web site or undermine the legitimate operation of the Giveaway is a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages and costs (including without limitation attorneys’ fees) from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

RELEASE AND LIMITATIONS OF LIABILITY:
Except where prohibited, by participating in the Giveaway, entrants agree to release and hold harmless Carl’s Golfland Inc., and their respective parents, subsidiaries, affiliates, and their respective agents and agencies, and their respective officers, directors, employees and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Giveaway or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Giveaway, including but not limited to “phishing” efforts directed at entrant by third parties; (b) technical errors related to computers, servers, providers, printers or telephone or network lines; (c) printing errors; (d) errors in the administration of the Giveaway or the processing of entries/plays; (e) late, lost, or undeliverable mail; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Giveaway or receipt of any prize. Entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Giveaway and in no event shall the Released Parties be liable for attorney’s fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. If, for any reason, an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another Giveaway entry; provided that if it is not possible to award another entry for any reason, Sponsor, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any prize offered herein. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than stated number of prizes as set forth herein to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.

Winner List requests will be available after the Giveaway end date (listed above) and will be accepted no later than 6 months after the end date of the Giveaway as listed in the Giveaway Post.

"Guess the number" Instagram Giveaway

CONTEST PERIOD:
The Contest will take place online via Instagram, from 1/7/25 through 1/14/25.

ELIGIBILITY:
The Carl’s Golfland “Guess the Number of golf balls” game (the “Contest”) The Contest is open only to persons at the time of entry who are (a) legal residents and physically reside in the forty-eight (48) contiguous United States or the District of Columbia, (b) eighteen (18) years old or the age of majority (19 in Alabama and Nebraska, 21 in Mississippi) and (c) Must follow the Instagram pages of Carl’s Golfland (@carlsgolfland) Cobra Golf (@cobragolf) and Vanguard Motors (@vanguardmotors). Employees, contractors or interns of the Contest Entities, and each of their respective divisions, affiliates, parent companies, subsidiaries, advertising and promotion agencies (including, in each case, immediate family members) are not eligible for a prize in this Contest. For purposes of this Contest, “immediate family members” is defined as spouses, siblings, parents, children, grandparents and grandchildren, whether as "in-laws", or by current or past marriage, remarriage, adoption, co-habitation or other familial extension, and any other persons residing at the same household location, whether or not related.

HOW TO ENTER:
To enter the #Contest, participants will access the Instagram post entitled “Carl’s Golfland DS-Adapt Contest” Instagram post where people will be asked to guess how many golf balls we put in the Shelby Cobra (car) pictured in the post. There is NO cost to enter. Making a purchase from any of the entities list will not increase your chances of winning. Entrants can only make one guess. In case of a tie all duplicate winners will be placed together for a random draw. The Contest is a skill-based guessing game. Rules for the Contest are described below. Contestants must be following Carl's Golfland (@carlsgolfland), Cobra Golf (@cobragolf) and Vanguard Motors (@vanguardmotors) at the time of the drawing, as well as like the original post.

DETERMINATION OF PRIZE WINNER:
The Contest winner will be the participant who makes the most accurate guess of the actual number of golf balls in the car without going over. In the event of a tie, the correct participants will be entered into a random drawing to determine potential winner. Sponsor and/or its representatives will serve as the judges of the Contest. All decisions by the judges are final and binding on all entrants.

Odds of winning depend on the number of eligible entrants and the ability of the entrants during the Contest.

PRIZE:
PRIZE & APPROXIMATE RETAIL VALUES (ARV): A full set of Cobra DS Adapt Golf Clubs ARV $2100.00.

ENTRANTS’ AGREEMENT TO ABIDE BY OFFICIAL RULES:
By entering, entrant agrees to be bound by these Official Rules and agrees that any dispute with regard to the conduct of this Contest, rule interpretation, or the awarding of the prize shall be submitted to Sponsor, whose decision shall be binding and final. Sponsor reserves the right, in its sole and absolute discretion, to modify, cancel, or suspend this Contest, or to amend the Official Rules at any time, without prior individual notice, should any factor interfere with the administration, security, or proper play of this Contest as contemplated by these Official Rules.

RELEASE OF LIABILITY:
By entering, entrant agrees to release and hold harmless Sponsor and its officers, directors, employees, agents, representatives, affiliates, and subsidiaries (“Releasees”) from any injury, loss or damage to person, including death, or property due in-whole or in-part, directly or indirectly, to the acceptance or use/misuse of the Prize, participation in any Contest-related activity, or participation in the Contest.

CHOICE OF LAW:
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and the Sponsor in connection with this Contest shall be governed by, and construed in accordance with the laws of the State of Michigan, without giving effect to any choice of law or conflict of law rules or provisions of any other jurisdiction that would cause the application of the laws of any jurisdiction other than those of the State of Wisconsin.
